These terms apply between you and Cre8ive Marketing Limited and govern your use of the Cre8ive Demographics portal. Please read them carefully, as they affect your legal rights.
These terms apply between you, the user of the website and portal at www.demographic-data.co.uk (the "Portal"), and Cre8ive Marketing Limited, which owns and operates it. By using the Portal you agree to be bound by these terms. If you do not agree, please stop using the Portal. You must be at least 18 years old to use it, and by using it you confirm that you are.
All content on the Portal, and all demographic data, reports, maps and other outputs we provide, are owned by Cre8ive Marketing Limited or our licensors and are protected by copyright, database rights and other intellectual property rights.
We grant you a licence to use the reports and data you purchase for your own business purposes, in line with any product-specific usage terms shown at the point of purchase. You must not resell, redistribute, sublicense or publish our data or reports, or extract or re-use a substantial part of our underlying database, without our written permission.
You must not use the Portal: in any way that damages it or interferes with another person's use of it; for any unlawful, harmful, abusive, fraudulent or otherwise objectionable purpose; or to copy, transmit or store content protected by copyright without permission.
You must provide accurate and complete registration details and keep them up to date. You are responsible for keeping your login details confidential and for all activity that takes place under your account. Please tell us immediately if you suspect any unauthorised use. Access credentials may not be shared with or transferred to anyone else. We may suspend or cancel your registration if you breach these terms, and you may close your account at any time by contacting us.
The Portal uses two purchasing models: drive-time reports are paid for using credits bought in advance, while sector reports and other data products are paid for per item. Prices are shown on the Portal and are stated as exclusive or inclusive of VAT as indicated. Payment is taken at the time of purchase through our payment provider, Stripe. Credits and purchased reports are licensed for your use as described at the point of purchase. Unused credits remain valid while your account is active. Except where required by law, payments for digital reports that have already been delivered are non-refundable.
We aim to keep the Portal available but do not guarantee uninterrupted access, and we may suspend it for maintenance, security or capacity reasons. Our demographic data is provided on an "as is" basis: it is derived from third-party and statistical sources and is intended as guidance, not a guarantee of accuracy for any particular property, person or decision. You are responsible for how you use it.
The Portal may contain links to other sites that are not under our control. We are not responsible for their content and accept no liability for any loss or damage arising from their use. A link does not imply our endorsement.
Use of the Portal is also governed by our Privacy Policy, which is incorporated into these terms by reference.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded under applicable law.
Subject to that, and to the maximum extent permitted by law, we are not liable for any business losses (including loss of profit, revenue, anticipated savings, data, goodwill or commercial opportunity), for any loss or corruption of data, or for any indirect or consequential loss, and we are not liable for events beyond our reasonable control.
You may not transfer your rights under these terms to anyone else. We may transfer our rights where we reasonably believe your rights will not be affected. We may vary these terms from time to time by posting an updated version, which applies from the date it is posted; please check this page regularly. If any provision is found to be invalid or unenforceable, the remaining provisions continue in force. These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute.
